Welcome to CommentLens360. These Terms of Service ("Terms") govern your access to and use of our Chrome extension and web services. By using CommentLens360, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using CommentLens360, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our service.

2. Description of Service

CommentLens360 is an AI-powered tool that analyzes comments from YouTube and TikTok videos to provide insights, sentiment analysis, and recommendations for content creators. Our service includes:

• Comment extraction and analysis from video platforms
• AI-powered sentiment analysis and insights
• Trending topics identification
• Content optimization suggestions
• Export capabilities (CSV, Markdown)

3. User Accounts

3.1 Account Creation

• You must be at least 13 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Security

• You must immediately notify us of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payment

4.1 Free Trial

• New users receive a free trial with limited features
• Free trial includes: 3 analysis sessions, up to 20 comments per analysis
• Free trial limitations are clearly stated in our service

4.2 Premium Subscription

• Premium subscriptions are available on a monthly or yearly basis
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time
• Refunds are subject to our refund policy (see Section 8)

4.3 Payment Processing

• Payments are processed securely through Paddle, our payment processor
• You agree to provide valid payment information
• You authorize us to charge your payment method for subscription fees
• All prices are in USD unless otherwise stated

5. Acceptable Use

5.1 Permitted Uses

You may use CommentLens360 to:

• Analyze comments from public videos on YouTube and TikTok
• Generate insights for your own content or research purposes
• Export analysis reports for your personal or business use

5.2 Prohibited Uses

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to reverse engineer, decompile, or hack our service
• Use automated scripts or bots to access our service
• Share your account credentials with others
• Use the service to harass, abuse, or harm others
• Infringe on intellectual property rights
• Interfere with or disrupt the service or servers

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of CommentLens360, including but not limited to text, graphics, logos, and software, are owned by us or our licensors and are protected by international copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain ownership of any comments or data you analyze. However, by using our service, you grant us a limited license to use your data solely for the purpose of providing our analysis services.

6.3 AI-Generated Reports

AI-generated analysis reports are provided for your use. You may use these reports for your own purposes, but you may not claim them as your original work for commercial purposes without attribution.

• We strive to provide reliable service but do not guarantee uninterrupted access
• We may perform maintenance, updates, or modifications that temporarily interrupt service
• We are not liable for any downtime or service interruptions
• We reserve the right to modify, suspend, or discontinue any aspect of the service at any time

8. Refunds and Cancellations

8.1 Subscription Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will continue to have access to premium features until the end of your billing period

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMENTLENS360 AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or completely secure. AI analysis results are provided for informational purposes and should not be the sole basis for business decisions.

You agree to indemnify, defend, and hold harmless CommentLens360 and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or analyze

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

12.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You fail to pay subscription fees
• We discontinue the service

12.3 Effect of Termination

• Upon termination, your right to use the service will immediately cease
• We may delete your account data within 30 days
• Any outstanding fees remain due and payable

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of this page
• Posting a notice on our website
• Sending an email notification (for significant changes)

Your continued use of the service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service.

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service shall be resolved through binding arbitration or in the courts of Hong Kong Special Administrative Region.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CommentLens360 regarding the use of our service and supersede all prior agreements and understandings.
